 a. The agent will receive a commission plus VAT at the prevailing rate from the customer (currently the addressee of the written property details) for evidence or negotiation of a main contract (rental or sales). The rate of commission is to be shown in the firm offer (written property details).

b. The agent will not request, accept the promise of, or accept payment from a person looking for property for agency or for evidence of the opportunity to complete a property rental agreement or sales contract, unless the agent is appointed to do so expressly and solely by the person looking for property.

c. Commission is earned and payment due immediately on signing the main contract. The same applies to signing a main contract with differing contents where the commercial identity of the contract is retained.  


The client is obliged to inform the agent about completion of the main contract immediately in writing and to disclose the actual sales or rental price shown in the main contract.

All information provided to the client by the agent is confidential and intended for the client in person. The client is not permitted to pass this information on to third parties without written agreement from the agent. Otherwise he is liable to the agent for compensation: provided that all other legal requirements are met, in the event of a primary contract being signed by a third party, this can be equivalent to the amount of sales commission foregone. If, due to information being passed on, a main contract signed with a relative, an associated party or a party with which the client is involved, the client is obliged to pay the commission.

The agent is liable for loses arising from personal injury, bodily harm or damage to health in accordance with statutory regulations. For other damages the agent is only liable in the event of gross negligence or intent.

The agent is also permitted to work on a commission basis with the other contracting party.
